Definition of Fraud

Fraud is defined as an act of deception, omission or falsification intended to gain special benefit or advantage for the party committing the fraud or for other parties, or to avoid an obligation or cause loss to another party.

The term "fraud" is normally used to describe insurance violations including, but not limited to, deception, bribery, forgery, extortion, embezzlement, misrepresentation, misdescription and non-disclosure of material facts or conspiring.

Insurance fraud is defined is defined as an act or omission of an act intended to gain dishonest or unlawful advantage for theparty committing the fraud or for otherparties.

Fraud may, for example, take the following forms:

  • Misappropriation of funds and assets of the company.
  • Deliberately misrepresenting,concealing, suppressing or notdisclosing one or more material factsrelevant to a financial decision,transaction or perception of theinsurer’s status.
  • Abusing authority, a position of trustor a fiduciary relationship.
